This HOLD HARMLESS AGREEMENT (this “Agreement”) is made effective between Ares Fabrication (hereinafter “Ares Fab”) and Third Party (hereinafter “You”) upon purchase of any product or installment of any product from Ares Fab.
By purchasing or installing a product from Ares Fab you shall fully hold harmless Ares Fab from any and all claims, lawsuits, demands, causes of action, liability, loss, damage, and/or injury of any kind whatsoever (including without limitation all claims for monetary loss, property damage, equitable relief, personal injury and or wrongful death), whether brought by an individual or other entity, or imposed by a court of law or by administrative action of any federal, state, or local governmental body or agency, arising out of, in any way whatsoever, any acts, omissions, negligence, or willful misconduct on the part of YOU, its officers, owners, personnel, employees, agents, contractors, invitees, or volunteers. This indemnification applies to and includes, without limitation, the payment of all penalties, fines, judgements, awards, decrees, attorneys’ fees, and related costs or expenses and any reimbursement to Ares Fab for all legal fees, expenses and costs incurred by it.
You acknowledge, by buying or installing one of our products, the risks associated with the product and agree to waive Ares Fab from any responsibility to damage incurred by you or others or to your property during installation, use, or other circumstances.
By buying or installing any product from Ares Fab, I indicate that I have read this disclaimer and have agreed to its terms on my own free will and that I am at least 18 years old and am fully competent.
